Volunteer Release & Waiver of Liability

This Release and Waiver of Liability (the “Release”) is executed as of the date/time of the “Serve on this Mission” form submission as captured by the http://www.heartstohandsclt.org SQL database server timestamp. The “Volunteer,” or the "Volunteer's" parent/legal guardian if under 18 years of age, acknowledges having read this “Release” in its entirety upon submitting the “Serve on this Mission” form and expresses his/her understanding and intent to enter into this Release and Waiver of Liability willingly and voluntarily.

The “Volunteer” desires to participate in Hearts to Hands CLT Mission Activities (the “Activities”) wherever, whenever, or however they may occur and to engage in "Activities" related to serving as a volunteer. The “Volunteer” hereby freely, voluntarily, and without duress executes this “Release” under the following terms and conditions:

Release & Waiver:
The “Volunteer” hereby releases and forever discharges and holds harmless Hearts to Hands CLT and its founders, officers, sponsors, agents, volunteers, and affiliates (“the Organization”) from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services the "Volunteer" provides to the "Organization."

The "Volunteer" understands that this "Release" discharges the "Organization" from any liability or claim that the "Volunteer" may have against the "Organization" with respect to bodily injury, personal injury, illness, death, or property damage that may result from the "Volunteer’s Activities" with the "Organization", whether caused by the "Organization" or otherwise. The "Volunteer" understands that all future claims that may be made by the “Volunteer’s” family, estate, heirs, or assigns for property damage, personal injury, or wrongful death are also waived under this "Release."

Insurance:
The "Volunteer" understands that the "Organization" does not assume any responsibility for or obligation to provide financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. The "Volunteer" expressly waives any such claim for compensation or liability on the part of the "Organization" beyond what may be offered freely by the "Organization" in the event of injury or medical expenses incurred by the "Volunteer".

Medical Treatment:
The "Volunteer" releases and forever discharges the "Organization" from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during the "Volunteer's" tenure with the "Organization."

Assumption of Risk:
The "Volunteer" understands that the services he/she provides to the "Organization" may be hazardous, including but not limited to missions that often take place in Center City Charlotte on busy streets and amongst heavy pedestrian and vehicular traffic. The "Volunteer" hereby expressly and specifically assumes the risk of bodily injury or harm from mission "Activities" and releases the "Organization" from all liability for theft, robbery, valdalism, injury, illness, or death which may result during mission "Activities". The "Volunteer" also assumes all responsibility for any and all risk of property damage that may be sustained while participating in any voluntary efforts, exercises or other activity of any nature, including the use of equipment and facilities of the "Organization".

Media Release:
The "Volunteer" does herby grant and convey unto the "Organization" all rights, title, and interest in any and all photographic images, video, or audio recordings of the "Volunteer" or the "Volunteer's" likeness in connection with providing volunteer services to the "Organization." The "Volunteer" relinquishes all rights to, including but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings taken by the "Organization" during mission "Activities." The "Volunteer" also grants exclusive rights to post these items on social media platforms and the "Organization's" website.

Miscellaneous:
The "Volunteer" expressly agrees that this "Release" is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina and that this "Release" shall be governed by and interpreted in accordance with the laws of the State of North Carolina. The "Volunteer" agrees that in the event that any clause or provision of this "Release" shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this "Release" which shall continue to be enforceable.
